New rules of the Ministry of Natural Resources for subsoil users: separate storage of waste and reclamation projects

The Russian Ministry of Natural Resources clarified the key requirements for working with waste subsoil use. The new rules concern separate storage of overburden and the mandatory inclusion of data on the reclamation project in the technical design. These changes directly affect the approval of documents and the implementation of new mining projects.

The main requirement of the department is the separate storage of waste. Overburden that is intended to be used and that which is considered waste should not be placed in the same dump. This provision is enshrined in Order No. 247 of the Ministry of Natural Resources. Violation of this rule may lead to refusals to approve technical documentation.

Particular attention is paid to the use of waste for land reclamation. If the technical project involves the use of overburden to restore territories, it must contain information about the developed reclamation project. It is important to note that it is not required to obtain a positive conclusion from the state environmental assessment for this project before the approval of the technical design. This removes unnecessary bureaucratic burden from companies.

At the same time, Rosprirodnadzor often requires subsoil users to provide an already approved reclamation project at the stage of approval of the technical project, which leads to refusals. The Ministry of Natural Resources clearly indicated that the design of the use of rocks for reclamation is carried out within the framework of a separate project, and not a technical development project deposits. For the examination of a reclamation project, title documents for land are also not required; cadastral numbers and information about legal holders are sufficient.

A similar approach applies to the use of waste during the liquidation of mine workings. There is no need to submit a completed liquidation project along with the technical design. It will be agreed upon separately, immediately before the start of work. This allows companies to flexibly plan their activities and not have to pay for the disposal of waste intended for future conservation.

These clarifications help subsoil users to correctly formulate documents and avoid mistakes that hinder the commissioning of fields. Compliance with the requirements ensures the successful completion of approvals and reduces risks during project implementation.
